Another thing with older veterans is that for 40 to 50 years they have dealt with constant pain. The pain and discomfort is always there. Some days are worse than others. The older veteran, as trained, pushes through it to be able to function. Older veterans adjust to the conditioning by the pain. Older veterans can take higher pain levels that would cause younger people to double up in pain.

I recently had a VA exam and my examiner could not have been better. I was being examined, primarily, for sleep apnea. The examiner had all of my records on her computer and she literally connected my sleep apnea to my hypertension, vertigo and kidney desease/cancer. I believe the Lord provided this examiner and it was a true blessing. By the way, I'm a Vietnam era veteran and was an 11B/infantry while serving.

Question, if raters are assuming veterans are just trying to get paid, isn't that going against their rules to give veterans the benefit of doubt?

I just did my claim for tinnitus and it was really fast start to finish 16 days rated at 10%. I am shocked it was so fast. Did the claim by myself.

What about 38CFR 4.59 "painful motion rule" The VA would rate it @ 10% per affected joint with the exception of the shoulder which is rated @ 20% regardless of ROM if I'm not mistaken. Also look up 38cfr 4.40/4.45 all related to how the VA would rate for pain.

When I was going through the retirement process, a doctor was supposed to go through the medical record and write a report. The Doctor I had at the Naval Hospital refused to do it. I had to let the Command Master Chief Know and then I got a write up. Of course not knowing what should be in there and the guy probably did the least he could. I am 71 and still pissed off about my retirement, no exit evaluation, no ceremony...nothing from anyone.
