  A Living Trust made sense to me since I have property in two different States. Easier than setting up Transfer on Death Deed in one State and a Ladybird Deed in the other.

  we live in Texas. I have all my brokerage and retirement accounts done with Beneficiary listing; POD for Bank accounts done; TODD for house done. There is a way to have the Cars we have ( in joint name with spouse ) easy to transfer title upon my death by the spouse so as to make it easy for her to sell any car with no hassles .My estate planning attorney helped me with some of these items.  I feel reasonably satisfied that in our case, we are not likely to have to go through probate ( either my wife or our Adult children).  Thanks for confirming this information.

  For many people probate is not something to get crazy over.  It does take some time.  For example, in my state (NY) there is a 7-month mandated delay to give creditors an opportunity to make claims against the estate.  That's only fair; the executor still has the ability to contest any potentially invalid claims, and few heirs want to hang those with legit claims ou to dry.  Over and above that, when there is a house involved it usually takes substantial time to ready a property for sale and then go through the transaction, whether there is probate or not.  When an elderly person passes away in possession of a home there is almost always a lot of fixing up to do before a house is ready for sale.  So the probate time will run parallel with many non-probate items.  There are many cases with more complexities which need legal/planning help.  But most are not so.

  Avoid private.  Only living child of the primary owner who happens to be US Military, child born US Military too. Love and care for your parents for all your life and give them extra care they need in the last 16 years of senior kiving. Teach them and warn them about predators and scammers and keep them secure. And  keep relevant information before someone even tries to argue about it including a counter arraignment out of the court

  This was a very helpful breakdown of probate and the different ways people can avoid it without automatically relying on a trust. I liked how each option was explained honestly, including the benefits, limitations, and possible tax or control issues. The examples around gifting, joint tenancy, beneficiary designations, and charitable life estates made the topic much easier to understand.
