  I&apos;m a retired Idaho lawyer. So, just a reminder. This is NOT an appeal. This is a post-conviction relief petition. Entirely different than an appeal. Under Idaho law, a defendant convicted of a crime must file a Notice of Appeal with the clerk of the district court within 42 days from the date stamped on the judgment or order. He obviously did not do that because pursuant to the plea agreement, he could not appeal his judgment. However, even though he could not file an appeal, he can file the post-conviction relief petition within 1 year + 42 days of the date he was found guilty by admitting he was guilty. Under Idaho Code § 19-4902(a), a post-conviction relief petition must be filed within one (1) year from the expiration of the time for a direct appeal (a direct appeal having to be filed within 42 days of judgment). Thus, he had until about September 3, 2026 to file the post-conviction relief petition. How this plays out will depend totally on the rules of civil procedure, as there is no longer a criminal case.

  The fact that he got a public defender shows that he doesn’t have much money. Steve G keeps saying that. Someone reported it’s only a few hundred dollars, mostly from his Mom. There’s also a battle between the defense experts. There was also hair on the bed and wall. Which was never tested. Dr Turvey also says there’s chain of custody issues on the bed from Xannas room, and the knife sheath. And, DNA issues as well. This really needs to go to court. Let’s put all the guessing to rest.

  This case needed a trial. The probergers the guilters the now hangrybergers- a trial needed to happen- should have happened! So what if he wants to take it to trial- don’t see why anyone would worry if it did go- we all want real justice. Not some plea deal. And another thing. We all are out here bashing him for about him filing a PCR. Prosecution allowed a Plea Deal on 4 college people that got massacred……. How about we talk about that… how does that even happen? That’s the problem with our Justice system. Right there.

  rejoice in the fact that he is hating his life so bad in prison he is willing to risk it all and be retried and potentially get death penalty. &nbsp;That&apos;s how bad he hates his life.

  It seems like he just wants to get his lick back from all the unkind words that the family left him with. Now, he&apos;s changed his mind to baske in seeing their pain. And this judicial system will oblige.🙄
