Why I Was Subpoenaed in the Highland Park Shooting Lawsuit?

I’m not a party to the lawsuit. I don’t represent Smith & Wesson. I didn’t sell the rifle. I don’t know the shooter. And after searching my own work, I couldn’t even identify a review by me of a Smith & Wesson M&P15. Nevertheless, the subpoena seeks years of content, communications with Smith & Wesson, audience demographics and analytics, test-and-evaluation history, contracts, compensation information, and even records showing whether the Highland Park shooter ever followed me, watched my content, commented, messaged me, or otherwise interacted with anything I produced. In this video, I explain why the Protection of Lawful Commerce in Arms Act matters, how the “predicate exception” has been used in firearms litigation, what happened in City of New York v. Beretta and the Sandy Hook litigation, why gun media is being pulled into this case, what the subpoena actually asks me to produce, and how I responded. I also get into one part of the subpoena that I find particularly troubling: its attempt to sweep independent editorial content into a definition of advertising that includes “organic non-paid marketing.” And stay through the end, because this leads directly into my next video: the contracts content creators sign with manufacturers, including defense and indemnity provisions that can potentially leave creators paying somebody else’s lawyers.
