Nintendo updated their EULA on the wii back then stating they can "brick" your system. That didn't start with the switch.

Its really interesting, despite history proving piracy dips when games are affordable and accessible, companies are always worried about some way to make the hardware or software ‘pirate proof’. Pirates are gonna pirate, but many people are happy to buy the company’s version of something when they don’t feel like they are being grifted or robbed.

Nintendo's approach to fighting piracy: put crippling limitations on the hardware & threaten consumers with bricking their tightly locked down devices.<br>Valve's approach to fighting piracy: make buying games convenient & occasionally put games on sale. The devices are unlocked & consumers are free to tinker with them or run whatever sort of third-party software they want.

Kinda funny now that SEGA's Sonic Racing Crossworlds is the final crack for Nintendo even remaking the infamous SEGA Genesis commercial
