The canon is that the Thalmor succeded destroying Nirn after TESV and that is why Betesda is incapable of making TESVI.

Killing a thalmor in the presence of NPCs doesnt result in you gaining a bounty, and thats all that needs to be said

The Thalmor are the only faction that are not an antagonist and that you can't choose to ally or even be indifferent to. The dragonborn is canonically against the Thalmor and that says something. I think they'll be the big bad of ESVI
