UK Police Can Raid the WRONG House — Here's Exactly What to Do if They Come to Yours (Solicitor)

It's 5am. You're asleep in your own home, having done nothing wrong — and the front door explodes inward. Boots, shouting, torches: a team of police officers pouring through your house. And sometimes, they're at the WRONG address. It happens to completely innocent people — through a mistyped digit on a warrant, out-of-date intelligence, or a suspect's "last known address" where a different family now lives. As a criminal defence solicitor I show you exactly what to do in that moment: how to tell in seconds whether they're even allowed to be there, the one sentence to say, the things to write down — and why a wrong-house raid is, in law, unlawful, and can end in a claim the police have to answer. I'm Oliver Bennett. I'm a criminal defence solicitor here in England and Wales — fifteen years standing in a lot of hallways the morning after, with families who were raided by mistake and had no idea that what happened to them was, in law, unlawful. This isn't legal advice; it's the plain-English version of what I wish every one of them had known before the door ever went in. 📋 WHAT THIS VIDEO COVERS ✅ WHY it happens: address errors, out-of-date intelligence, and raiding a suspect's "last known address" where an innocent family now lives — you don't have to have done anything for it to land on you ✅ WHEN a raid is LAWFUL: in almost every case the police need a WARRANT from a magistrate/judge (PACE s.8/15/16) that NAMES the premises. A warrant is tied to an address — if it isn't yours, it's not a key to your door. Without-warrant powers (s.17 to arrest/save life, s.18 & s.32 after an arrest) need a genuine, specific reason — "we had a hunch" is not a power ✅ THE MOMENT: do NOT physically resist or fight (that gets you hurt or arrested). Ask, calmly: "Show me the warrant — does it name this address?" You're entitled to be shown the warrant and given a copy ✅ BECOME THE RECORD: officers' names + shoulder numbers, the time, the reason given; photograph the damage and the search if you safely can. Documenting is NOT obstructing — obstruction means physically blocking/hiding; asking to see the warrant is your RIGHT ✅ HOW A WARRANT MUST BE EXECUTED: on request they identify themselves, produce/show the warrant and give a copy; reasonable force only if needed to enter; search only to the extent (and for as long as) the warrant allows ✅ ★ A WRONG-HOUSE RAID is UNLAWFUL: an invalid/wrong-address warrant means no authority to cross your threshold — potential trespass, false imprisonment, and a breach of Article 8 (respect for your home). PACE Code B says if the wrong premises are searched, everything possible must be done to put it right. It can found a COMPENSATION claim ✅ AFTER: get a copy of the search record, keep your notes/photos, and take it to a civil-liberties / actions-against-the-police solicitor; consider a complaint to the IOPC ⚠️ DISCLAIMER General information on the law of England & Wales — not legal advice. The law can turn on the exact circumstances; if you're arrested or your home is searched, get a criminal or civil-liberties solicitor and take the free legal advice you're entitled to. #KnowYourRights #PoliceRaid #WrongHouse #UKLaw #SearchWarrant #PolicePowers #PACE #HumanRights #OliverBennett #KnowYourRightsUK
