The prosecution's failure to continually turn over the mountain of discovery and then turn it over at the last minute creates ineffective assistance of counsel per se.

It isn't a regular case. BK's new lawyer made a good argument as to why Hippler should recuse himself. His statements at sentencing show a man who would not believe anything BK says therefore not impartial. Hope that details emerge as to the 6 day turn around from a "going to trial but now a plea".🎉

The State's motion to dismiss isn't worth the paper it's written on. And how about the Idaho code that says you can either file a motion OR reply, but not both?

Also, What Payne wrote in his PCA is NOT what Bethany, and Dylan, testified to at the grand jury. On 4/25/25, or it was 4/24/25- Hitler cited grand jury transcripts as what he was citing when writing his decision.he specifically said she hat they said and it is NOT what Payne said they said.
