I would not advocate for the matter to proceed by way of oral evidence. Resorting to oral evidence may open the matter to a broader factual enquiry, particularly where there are material disputes of fact. This may prejudice the applicant’s case by exposing him to cross-examination and potentially introducing evidence that falls outside, or expands upon, the case made out in the affidavits. It may also create further factual disputes and unnecessarily prolong the proceedings. In these circumstances, it would be preferable for the matter to be determined on the papers, insofar as the applicable legal principles permit.
