Securities litigator/lawyer here. The law is the same - material misstatements or omissions. Intent is generally what bumps to criminal. Unfortunately, whether there will be a grand jury convened to seek an indictment is solely up to DOJ attorneys. They have discretion in what cases to pursue. This one smells like it’ll result in an indictment, but we’re in an interesting timeline. So, we’ll see!!

I was a supplier for one of these brands and they stopped paying us for our orders sent to customers around key dates im finally seeing why lol. We ended up getting paid however I know other suppliers got screwed a lot of cash for orders they sent.
