  It has been common practice that many actors would take costumes or props after the program had ended it's run.  I have never heard of any company demanding returns.  DesiLou never tried to reclaim it either.  Paramount never asked Roddenberry for its return while Roddenberry had it in his posession.  Thus  It's Roddenberry's

  I'm a lawyer but not in California.  You presented a very good summary of the issues.  I suspect that the grant of summary judgment would be overturned on appeal.  There are too many factual and legal issues.

  If you loan something and is it willfully not returned, it has been stolen. While a friendly loan starts out completely legal, willfully refusing to give the item back changes everything. In the legal world, this crosses the line from a civil favor into a crime.  There is nothing in Gene's letter that declares it as the first nor last attempt on his part and/or his behalf to get the Enterprise returned and/or located. The California laws on storage unit contents cannot create ownership that never existed.  Meaning, the law cannot deem that any contents of a storage unit if those contents were stolen transferrable to any party other than the legal owner.  Doing so would create a legal safe haven loophole where any property could be stolen placed into a storage unit and, once the unit's rental has become delinquent, passed onto any bidding party.

  If my neighbor &quot;loans&quot; a friend their lawnmower, and it doesn&apos;t get returned, it&apos;s still theft. &nbsp;If the neighbor doesn&apos;t want to ruin the friendship, never involves police, and never gives up hope that it will be returned until their death, it&apos;s still theft. &nbsp;If the lawnmower is loaned or gifted in turn to someone else, it is no less stolen and that other person is (unintentionally) receiving stolen property. &nbsp;To contest the locker sale, per California law, one would have to have known that the secretly-held, long-missing, and unaccounted-for property was <i>inside of it before the sale,</i> an impossible condition to meet, unless you&apos;re Superman.

  If I understand this correctly, the legal argument may hinge on whether the two individuals who bought the storage locker knew what the model was when they discovered it in the contents. Because if they knew it was the missing Star Trek model and its history, then there would potentially be a strong argument that they knew the model was potentially the property of someone else. They seemed to take plenty of photos of the thing when they tried to sell it on eBay.<br><br>It sounds to me like this will end up getting settled out of court with a settlement of some sort. For how much? Who knows, especially with legal teams involved.

  Another story that went around is that Gene lent the model to Oliver &quot;Brick&quot; Price (Brick Price Movie Miniatures, later WonderWorks) in 1977 while Brick and Don Loos were building the Refit Enterprise model for Star Trek Phase II.
