  I've NEVER had an office job that complained about employees eating lunch at their desk. That's free labor from a salaried employee.

  Sherry tells him if he answers the phone or acknowledges a customer while on break— he’d violate a state law, and then harasses him for doing what she said. 🙄

  I ate lunch in my truck... I was IT  one guy came to my window my mouth full of sandwich  my computer won't work....  I'm on lunch   I'll stand here and watch you till you are done with lunch   He stood there till I ate my sandwich... I clocked in early... fixed his computer  which consisted of a wrong key entry you can't enter a letter in a numeric field.    Next week office manager came knocked on my window... then had to quit eating go fix her minor problem....  next day or so I went up down and parked in a local grocery store parking lot.     next day same  then had a cop come up and knock on my window...  why are you just sitting here.   resolution  I'm IT I'm not supposed to take a lunch break    six months later I retired......

  Personal life isn't work. You can be family or a lover but personal trust should never be an excuse for illegal work.

  Instead of taking Sherry's comolaint at face value, HR should have checked the security camera as she did during his review.  Had she done that, she would have seen how many of those comolaints were smoke.

  I can understand not wanting people eating at their desk if there is strong odor, but it was obvious this was a hit job from the first complaint.
