I just beat LVNV on a garnishment order this week. They started garnishing on my paychecks. Sheriff notified me that was gonna take place and I had 10 days to respond and sent me a WG-006 and WG-007 forms (they also have the forms on the sheriff website) and I sent right back to the sheriffs and LVNV had 10 days to answer and if they did not respond the sheriff automatically will remove by law the garnishment order and notify your employer and refund any money they still haven’t sent over. I did it right on time and sheriff gave me back all my money they were planning on handing over to LVNV.
If LVNV is already garnishing ur money submit the form to ur local CA sheriff department the order was placed on and I made sure I was not going to suggest a dollar amount, I put NONE 😂 if they do respond then a court date will be given and not only will you have the chance to make them prove they own the account but also you have an opportunity to prove you can’t afford it either with this economy. Now I’m where I watch this video because I do not know what happens next 😤😮💨

I'm being sued by LVNV for 1400$. I called them to try to settle the case they told me i have to pay them a dollar to see if i qualify. I told them i dont feel comfortable giving them my card information and they started screaming at me lol.

This is helpful.
I was told by a lawyer to ignore them. Disabled senior with social security as only income, no assets. He said they can try, but that I'm uncollectable because ss is my only income and should they win and try to take the money via bank garnishments, the bank stops it or they get a letter from lawyer and the money is returned.
I think I'm going to file for "inability to pay fees", then motion to dismiss.
If dismissal is not granted, then I'll file my response and force them to spend more than they already have for a thousand bucks.
They've already had to hire process servers to drive a couple hundred miles, then the Sheriff's fee to have it served plus filing fees.
Good grief, if they bought a thousand dollar debt at .04 a dollar, they've already lost money!
😂

Hi John, I have an LVNV problem. I have 2 different LVNV attornies contacting me by mail. One of them has sent me a letter telling me they are about to take the money from my bank account. I have not been served. What should I be doing now?

Hello I've just been served in the state of AZ from LVNV too but in my paperwork that I received from being served, they provided a copy of one of my bills from the previous credit card company. Does that provide enough proof for them??

Do you know a lawyer in MO? I requested documentation of the original contract at my continuance couple weeks ago and they are sending it to trial. They only sent the papers of them purchasing the debt as well as one single statement with my name/address on it

I never filed an answer. I am 72 on social security and pension and no assets.

LVN Funding sued me. Can I contact them to pay a portion of it? Or should I not even contact them? Thank you for your time and expertise.I did answer one of their lawsuits I had gotten in the regular mail but I mailed a response to the court. There are three other accounts they have.

John, have you ever experienced a case where these Junk Debt buyers are actually able to prove ownership of an account in court?
