  On August 24, 2024, Mr. Tucker Clements was issued a citation for an alleged violation of Section 5653(a) of the California Fish and Game Code. &nbsp;Section 5653(a) states: <br><br>The use of vacuum or suction dredge equipment by a person in a river, stream, or lake of this state is prohibited, except as authorized under a permit issued to that person by the department in compliance with the regulations adopted pursuant to Section 5653.9. Before a person uses vacuum or suction dredge equipment in a river, stream, or lake of this state, that person shall submit an application to the department for a permit to use the vacuum or suction dredge equipment, specifying the type and size of equipment to be used and other information as the department may require pursuant to regulations adopted by the department to implement this section.<br><br>However, on April 17, 2025, the Siskiyou County Superior Court dismissed the charge against Mr. Clements. &nbsp;The dismissal was granted after the Siskiyou County District Attorney&apos;s Office filed a Request For Dismissal on the grounds that:<br><br>The defendant has produced evidence that shows that he substantially complied with the scope of conduct allowed by Fish and Game Code section 5653(a). &nbsp;Pursuant to section 5653.8 ... &quot;person&quot; does not include a partnership, corporation or other type of association. &nbsp;The defendant substantially complied with the requirements of 5653(a) because he was acting as an agent of a partnership.&quot;<br><br>Fish and Game Code section 5653.8 states:<br><br>For purposes of Sections 5653 and 5653.3, “person” does not include a partnership, corporation, or other type of association.<br><br>The charge against Mr. Clements was dismissed because both the Siskiyou County District County District Attorney&apos;s Office and the Judge accepted the argument that Section 5653.8 exempted Mr. Clements from prosecution under Section 5653. &nbsp;However, it is not hard to imagine another judge or District Attorney in another county being less sympathetic to the argument.<br><br>if you were to be cited for a violation of Section 5653, having a written partnership agreement like the one available on the PLP website wouldn&apos;t hurt. &nbsp;It&apos;s not hard to create a partnership. &nbsp;Whenever two or more persons carry on a business for profit, if no other type of legal entity has been created (e.g. a corporation or LLC), they will be deemed to be members of a partnership. &nbsp;Perhaps it is time that you gentlemen register your partnership with the California Secretary of State.<br><br>I&apos;m not sure how in the absence of legitimate permits from the Department of Fish and Game and the California Water Resources Control Board &nbsp;a claim that a purpose of the dredging was &quot;reclamation&quot; would provide a legal defense. &nbsp;There doesn&apos;t seem to be a statutory basis for any such &quot;reclamation&quot; defense. &nbsp;However, with a sympathetic prosecutor and judge a &quot;partnership defense&quot; might even work outside of Siskiyou County. &nbsp;Don&apos;t be shocked if a &quot;partnership defense&quot; doesn&apos;t work outside of Siskiyou County. &nbsp;However, executing a partnership agreement and filing it with the Secretary of State is something you might want to consider. &nbsp;<br><br>Aloha

  The anti-dredgers don&apos;t realize how much toxic metal dredgers remove. &nbsp;When I was dredging, I seemed to get 2-3 pounds of lead and a couple of ounces of mercury for every ounce of gold. &nbsp;And the holes gave Salmon and other fish rest from the current and the tailings made good spawning beds.

  Watching the timelapse of the doggy chowing down on a stick and then coming after one of you to see what you were doing and then helping out &nbsp;was adorable, they really do put in the effort to be a part of our days!

  Great job on your reclamation! The creek is less polluted because of your hard work! More reclamation equals cleaner waterways!

  Clean out all that lead ,steel, mercury. Fish will love it! It&apos;s like cleaning your fish tank.But alot more fun.

  To clean the mercury off your contaminated gold &nbsp;in 24 hours, make your own Peracetic acid with household ingredients. Mix 50/50 Apple cider vinegar (or white vinegar) with hydrogen peroxide. (do this outside only) the catalyst to set it off is a couple drops of toilet bowl cleaner or &quot;Lime Away.&quot; (use a shot glass or Pyrex) Though the gas produced is toxic, this will eat away all the mercury overnight. Neutralize the waste by adding baking soda prior to disposal. Do a final rinse with rubbing alcohol. &nbsp;I have done this three times with Vermont gold and had success all 3 times. Heavy Pans!

  I rarely comment on videos , but I noticed that Israels panning technique (mostly the final reveal) is exactly how I pan, which I’ve never seen anyone else &nbsp;do it exactly like I do. &nbsp;I’ve been subscribed &nbsp;since ‘23 &amp; I have to say you guys really put in the necessary work &amp; totally have been blessed w/ the rewards!!

  I did a few weeks dredging in North Queensland in 1990, worked a deep hole in the river. Drove up to the hotel one night and locals informed me there was a 14 foot crocodile in that hole. Pulled the dredge and left.

  Get yourself a gardening claw to rake gavel. It allows the dredge to suck up the heavies while moving the oversize out of the way.
