I remember my law class example of a prescriptive easement was when a blind guy used to walk through a property on an continual basis for many years without the owner ever objecting. Then, the property was sold and the new owner put up a fence and he could no longer walk through the property. He sued and won, and the owner had to take the fence down.

My parents just bought property that has either a conservation easement or a setback to where they have to have area aeound their main property set aside for migrating animals. My mother actually chose their property because of this migration route.

Great video. My only suggestion would be to show some examples of plats with various types of easements...and maybe the supporting documents. You briefly mentioned the "deed book and page" as the place to look regarding the origin of an easement...I think? I had to play that back a few times to figure out what was said. But an example of that would be great too. When we bought our house, I had no idea about such things, but the plat showed a 10' easement along the back property line under the overhead power lines. Obviously this was pretty easy for me to figure out - but I would have been clueless if there'd been some kind of drainage or septic or right of way kind of thing going on. Very interesting topic.

I have a creek that ends in a public stormwater drain that goes under a public street. There is a 10ft drainage easement but due to the sewer not being able to handle the water flow during storms the creek has erosion that encroaches past the easement line. Is it the utility owners responsibility to keep the drainage within the easement? Or does the property owner have to suck up the land lost by erosion?

Personally I wouldn’t buy real estate without a real estate attorney. I’m not signing a bunch of legal documents without one. They also will make sure you know all these facts plus more

Here in bmt,tx easement is 50 feet from the middle of the street to your property some people get to used it an others have to move fences off but everyone here is treated differently in this one horse town

there is a 700ft telecom main line {old GTE} that runs through the center of a property that i looked at. that only has a quick claim deed from 1959,before the line was built.no easements are on the qcd.what can i do about this?

Have 5 acre plot with a power easement. And some neighbors dump yard waste. In your opinion what chance of them getting easement by prescription?

my grandpa died in 1988 has land on Kerr lake i have a easement but a neighbor fenced it off , but is using our land to cross to his other property but doesn't want people on his property. I have the deed and a copy of the easement. our land has never been through probate but I've recently started paying the taxes my uncle has been paying since 1988... and gave it to me to look after and pay taxes on. what should my next steps be? to survey it? or try and get it in my name?
