One of the best laws ever: Ambiguities in contracts must be resolved in favor of the party who did NOT draft the contract. Defendant's lawyer is hoping judge doesn't notice or know this. He gets to wrong. Being wrong is good for lawyers, it keeps them just humble enough to be bearable.

I respect the judge for pointing out the contract language was ambiguous at best. It seems the contract was intentionally written to be deceiving and contradict itself in hopes it could win either way. The refund policy and the cancelation clauses are misleading. In that case, the defendant should lose since the contract is not valid on its face.
