  I'm a non-attorney fiduciary accountant for a trusts and estates law firm with bar licenses in DC, MD, VA. Although you are in California, this is great information. Even non-attorney "team members" for clients need to understand all these intricacies to ensure non-attorney clients serving as trustees for family trusts comply with accounting rules and ethics. As the accountant, it's my responsibility to point out any accounting irregularities to the billing attorney. As the daughter of a beneficiary of a trust, it's also educational. Thank you!! ❤❤

  I dont have a trust, but I'd never make someone a trustee. i  dont have a good relationship  with or speak to.

  The Power of Attorney should be active until the executor takes over. In my case my siblings teemed havoc and not a damn thing was done. I.e. tenants were threatened, slander and false allegations happened with zero consequence. My siblings always caused turmoil in my parents life and now they're doing it to me. It's hard to endure but hopefully the truth will prevail.

  Maybe there should be a state registry of wills and trusts in each state where any new wills or trusts are counted. The attorney who was involved with the writing, notary involved and date, listed in that data bank.

  Document. Document. Document. Take pictures, capture video, get witnesses if possible, capture audio. Because when it comes down to the side it's your word against theirs but with proof, you stand a better chance. The only thing that will be a drawback is your lawyer. There's two kinds: a flounder and a shark. The flounders don't get anything accomplished and they let the opposing lawyer steam roll them. Do not get an old lawyer. They just can't keep up with the fast last of litigation. Great lawyers are diamonds. They aren't easy to find.

  My youngest brother was the one who wrote out the trust / will for my mother who can’t read nor write, by she signed it ignorantly by undue influence in 2022. <br><br>Today he filed a petition for appointment for the probate conservator for the person my mother. Without giving a notice prior to filling. He manipulated the probate court to his reasons for not giving notice was that we raise concerns of the well being of the Conservatee.<br><br>So now I found my mother at the care home and in my visit my mother expressed that she was scared of my youngest &nbsp;Brother.

  When you are checking into a trustee, and he says&quot; I&apos;m hiring a attorney for me and the trust has to pay for this attorney&quot; is that someone afraid of his power? Or he&apos;s not really sure of himself etc.?
