  Reddington said the judge had previously refused his request to bifurcate the trial &nbsp;- meaning split it into two separate phases. He apparently wanted something like:<br><br>Phase 1: Did the Commonwealth prove that Clancy actually committed the acts charged?<br><br>Phase 2: Only if Phase 1 is established, was she criminally responsible for those acts?<br><br>Because the judge wouldn’t separate those questions, Reddington says he was put in the position of having to present the lack-of-criminal-responsibility defense during the same trial in which the Commonwealth still carried the burden of proving the underlying crimes. <br><br>today’s hearing specifically says Reddington argued that the refusal to bifurcate effectively forced the defense to acknowledge culpability in order to present the insanity defense.
