I have a situation. My parents both passed away recently. One in August and the other 25 days later in September. I was sent a waiver of probate form from my sister who is the Executor of our parents will. I wanted to read the will before signing it. My brother and another sister (they both live out of state) signed it just so it would go quicker through the court. I told her I would NEVER sign a piece of paper or sign off on one that I had not even read yet. I was told by my sister I had to sign the waiver first THEN I could have a copy of the will to read. I talked with a probate lawyer and he said to tell my sister it was the opposite, you read the will first then you can sign the waiver. I have been living with my parents for the past 3-1/2 years taking care of them. My sister lives close by and helped too. Now that our parents have passed my siblings are trying to force me out of the house or make me pay rent. I am currently paying the utilities. I was not been able to work full time since I was taking care of my parents. My sister, the executor is also saying the one who is causing all of the problems will have to pay the extra costs for the hearing for probating the will which is on Dec. 3rd, 2025. Can my sister force me out of the house once the court appoints her executor? The house will be put up for sale at the end of the year. I have gone to work full time since the death of my parents and given only a few months by my siblings to save to move somewhere else. Yikes, I hope this is not too much personal info but I need some help!

The month-or-so gap between filing the will and the judge actually issuing letters testamentary is exactly why petition-stage filings and administration-stage filings need to be tracked separately instead of lumped into one probate list. In my experience pulling these records across a few thousand counties, that gap varies wildly by court backlog — some clear it in two to three weeks, others sit closer to ninety days, which directly changes when a personal representative can legally sell real estate. Worth flagging too: once assets pass by TOD or beneficiary designation like he mentioned, they never show up in the probate filing at all, so any list built purely off court records is going to undercount inherited property that's actually changing hands.
